## para As announced by the Company on 12 May 2023 that the High Court had fixed 30 August 2023 for decision of the Kuala Lumpur High Court Suit No.: 22NCC-362-09/2014. ## para The Company wishes to announce that the learned High Court Judge found the Company has established its claim for breach of fiduciary duties, breach of Sections 131 and 132E of the Companies Act 1965, fraud and conspiracy to defraud on the part of Tey Por Yee and Ooi Kock Aun. The learned High Court Judge has allowed the Company’s claim for a declaration that Tey Por Yee and Ooi Kock Aun have acted in breach of their fiduciary duties as directors of the Company. ## para The learned High Court Judge entered judgment against Tey Por Yee and Ooi Kock Aun with interest of 5% per annum to be calculated from 22 September 2014 until full and final settlement of the judgment sum. The judgment sum will be finalised and will be announced in due course. ## para The learned High Court Judge also awarded costs in the sum of RM650,000.00 in favour of the Company to be paid by Tey Por Yee and Ooi Kock Aun. ## para This announcement is dated 1 September 2023.
